Recovering uninsured losses

What are uninsured losses?

Any loss which a client suffers as the result of an accident that is not covered by their insurance cover.

These could be:

  • Damage to a vehicle where insurance is a third party, fire or theft
  • Insurance excess
  • Car hire expenses
  • Travel expenses
  • Loss of earnings
  • Personal injuries
  • Consequential loss e.g. where the damaged car is subject to a loan agreement and the write-off value is less than the outstanding amount on the loan.

How do I recover uninsured losses?

Many clients will have legal protection cover as part of their insurance policy. This provides a recovery service for uninsured losses where the other party has been shown to be responsible for the accident.

If the client has no legal protection, the only recourse is to take legal action for recovery from the other party. Legal advice should be obtained.
